PLYMOUTH, Mass. — A 21-year-old Brazilian national who is accused of raping a woman outside of a Plymouth sports bar earlier this month is now in federal custody, federal immigration officials said.
Luan Lucas De Souza Goncalves, of Plymouth, was taken into federal custody on Dec. 2, one day after local police arrested him on rape charges, federal officials said Monday.
Plymouth Police arrested De Souza Goncalves following a report that he raped a woman outside the Main St. Sports Bar and Grill in the early morning hours of Sunday, Dec. 1, according to court records.
De Souza Goncalves pleaded not guilty to the charges of rape and indecent assault and battery on a person over the age of 14 during his arraignment in Plymouth District Court on Dec. 2. He was held on $10,000 bond/$1,000 cash bail.
Federal immigration officers later arrested De Souza Goncalves at the Plymouth County Correctional Facility, Enforcement and Removal Operations Boston Acting Field Office Director Patricia Hyde said in a statement. He remains in federal custody.
A call to De Souza Goncalves’ attorney, Mark Byron, was not immediately returned on Tuesday.
De Souza Goncalves “has been accused of raping and assaulting someone in one of our Massachusetts communities,” said Hyde.
Hyde said the Plymouth County Sheriff’s Office honored the immigration detainer for De Souza Goncalves lodged by her office after his arrest. Authorities said De Souza Goncalves unlawfully entered the U.S. on July 22, 2023.
Plymouth police were patrolling the downtown area at around 1:20 a.m. on Sunday, Dec. 1 when they heard a commotion on Middle Street, next to the side door of the Main St. Sports Bar and Grill, police wrote in their report.
Officers heard a man yelling at De Souza Goncalves to “Get away from her,” referring to the alleged victim, who was “crying and hugging another female,” police wrote.
When officers approached a group of people standing outside the bar, a male witness said “Don’t let him leave!” and pointed to De Souza Goncalves, police wrote.
“He just raped her!” the witness then told officers.
The woman, “in hysterics,” was “profusely crying, unable to catch her breath, visibly shaken,” police wrote.
When officers asked the woman what happened, she told police she went to the bar with friends, and met De Souza Goncalves. The two began talking at the bar and exchanged Snapchat profiles.
At around 1 a.m., the two went outside to the parking lot and began kissing and touching each other outside of their clothing. She told police she initially consented to kissing and touching, but then changed her mind.
She then told De Souza Goncalves she needed to go back to her friends at the bar and did not want to continue kissing, but he ignored her and “began to further advance himself onto her,” police wrote.
The woman told police that she repeatedly said “No” to De Souza Goncalves and that she wanted him to stop “multiple times.”
De Souza Goncalves told police that he did not know the woman’s name and he referred to the woman as “her.” He also told officers that he and the woman had sexual intercourse outside the bar and that it was consensual.
He is due back in court on Dec. 20.
