25 Investigates: Recording reveals judge was aware of warrants when he released North Shore man

25 Investigates has obtained an audio recording of a court hearing where a convicted felon with 10 warrants from 4 different courthouses was set free.  We first reported on this case last Wednesday when 29-year-old Jean Cypien was arrested again on the same warrants.

Cypien appeared in Stoughton District Court on December 6th following a six hour stake out by Canton Police.

A court employee is heard telling District Court Judge Daniel Hourihan that Cypien had “7 warrants out of the Salem District Court, 1 warrant out Lynn District Court, and 1 warrant out South Boston Division of Boston Municipal Court.”

Judge Hourihan told Cypien, “I’m going to give you recognizance, that’s a promise for you to show up at these courts”  Cypien was not held on the warrants or required to post bail and he failed to show up for all 3 court dates that were set for him.

There is no mention on the courtroom recording of an additional warrant taken out by Melrose Police.  It stems from a November 19th shots fired call, where a masked man shot at least 2 rounds at an occupied vehicle on Mount Vernon Avenue.

Two law enforcement sources tell 25 Investigates even if the judge was unaware of the Melrose case, the nine warrants he was given should have kept Cypien behind bars.   One of his other charges was assault and battery stemming from a domestic violence case.

Melrose Police Chief told 25 Investigates Cypien he was surprised and frustrated by Cypien’s release, “with his history and the involvement of firearm. At the very least I would think the courts would at least put a bracelet on him with his history.”
